Welcome to Browsist AI! These Terms of Service ("Terms") govern your access to and use of the Browsist AI mobile application ("App"), website, and services (collectively, "Services"). By using our Services, you agree to these Terms.

1. Acceptance of Terms

By accessing or using Browsist AI, you confirm that:

• You are at least 13 years of age
• You have the legal capacity to enter into this agreement
• You will comply with these Terms and all applicable laws
• You have read and understood our Privacy Policy

2. Description of Service

Browsist AI is a comprehensive AI-powered browser assistant providing:

2.1 Core Features

• AI Chat Assistant: Conversational AI with multiple models (OpenAI GPT-4.1-mini, GPT-4o, GPT-5; Google Gemini 2.5 Flash, Gemini 2.5 Pro, Gemini 3 Flash, Gemini 3.1 Pro)
• AI Voice Chat: Real-time voice conversations with AI using Google Gemini Live API. Talk naturally and get spoken responses with multiple voice options (Kore, Aoede, Charon, Fenrir, Leda, Orus, Zephyr). Supports hands-free browsing commands — ask the AI to open websites, search the web, get weather, read webpages, and more via voice. Voice sessions consume messages from your plan quota.
• AI Video Chat: Live video conversations with AI where you can share your camera feed. The AI can see what you see and answer questions about your surroundings in real time. Supports front/back camera switching, picture-in-picture mode, and fullscreen video. Video sessions consume additional messages from your plan quota.
• Research Mode (PRO/PREMIUM only): AI chat enhanced with real-time web search, credible sources, and images from the web. Research Mode uses your IP address to determine your approximate location (country and city) to provide geographically relevant search results, including regional news, nearby businesses, and location-appropriate content. This feature requires an active PRO or PREMIUM subscription.
• Built-in Browser: Integrated web browser for seamless browsing without leaving the app
• Browser AI Summarization: Instant webpage summaries in 4 types:
  • Quick Summary - Brief overview in seconds
  • Detailed Summary - Comprehensive overview
  • Key Points - Bullet-point main ideas
  • Action Items - Actionable tasks and steps
• My Notes: Personal note-taking and organization system accessible from navigation menu
• AI Image Generation: Text-to-image creation using Google Imagen and DALL-E models
• Trending Topics: Discover trending content across categories with instant AI research capabilities
• Voice Input: Speech-to-text capabilities for hands-free interaction in chat
• Document Analysis: AI-powered analysis of PDFs, Word documents (up to 10MB), and images
• Multi-Device Sync: Optional cloud synchronization of chat history across devices
• Offline AI Pack (optional add-on): A separate monthly add-on (₹100/month) that runs AI models entirely on your device (Gemma, TinyLlama, Qwen2.5, DeepSeek-R1). When enabled, all processing happens locally with zero data transmission to our servers or any AI provider, and offline conversations are stored only on your device. On-device AI is smaller than cloud AI (answers may be less detailed) and supports text and voice only. Requires a one-time model download and a compatible device.

2.2 Integration Features

• Research Mode sources open directly in the built-in browser (PRO/PREMIUM subscribers only)
• Browser AI Summarization accessible via AI icon in browser bottom navigation
• Seamless workflow: Chat to Research to Browse to Summarize to Notes
• Voice-to-Browser integration: Voice commands can open websites directly in the built-in browser
• Multi-tab browsing with history and bookmarks

2.3 Built-in Browser Features

The integrated browser includes the following features:

• Ad Blocking: Optional feature to block advertising and tracking content. This may cause some websites to display differently or request you disable ad blocking. We are not responsible for website functionality issues when ad blocking is enabled.
• User Agent Modification: Our browser identifies as a standard Chrome or Firefox browser to ensure website compatibility. Some websites may serve limited functionality to in-app browsers, and this feature helps provide the full browsing experience.
• Desktop/Mobile Mode: Switch between mobile and desktop viewing modes for optimal website display.
• JavaScript Control: Option to enable or disable JavaScript. Disabling JavaScript may break website functionality.
• Cookie Management: Websites may set cookies which are stored locally. You can clear cookies in browser settings.
• Third-Party Website Content: We are not responsible for content, privacy practices, or functionality of third-party websites you visit. Each website has its own terms and privacy policy.

3. Subscription Plans & Pricing

3.1 Available Plans

  • NOT automatically included with PRO or PREMIUM - it must be purchased separately

3.2 Payment & Billing

• All subscriptions are processed via Google Play Billing (secure, PCI-compliant)
• Subscriptions auto-renew monthly unless cancelled before renewal date
• The Offline AI Pack add-on auto-renews monthly and is billed independently of your main plan - you may be billed for both your plan and the add-on
• Billing date: From your initial purchase date (e.g., subscribe on Oct 15 → renews on Nov 15)
• Prices shown in Indian Rupees (₹). Google Play automatically converts to your local currency
• Available in 190+ countries with automatic currency conversion
• Payment charged to your Google Play account at confirmation of purchase
• Usage quotas reset on your monthly billing date (not calendar month)
• Unused quotas do NOT carry over to next month
• Taxes/VAT applied per your country's regulations (added at checkout)

3.3 Cancellation & Refunds

• How to Cancel: Open Google Play Store app → Menu → Subscriptions → Browsist AI → Cancel Subscription
• Cancellation takes effect at the end of current billing period (no prorating)
• You retain full access until the paid period ends
• After cancellation, account reverts to FREE plan automatically
• Refund Policy:
  • Within 48 hours of first purchase: Full refund available (contact Google Play support)
  • After 48 hours: No refunds for partial months (per Google Play policy)
  • Exception: If service is unavailable for 24+ consecutive hours, contact us for prorated refund
• Unused message/image quotas do NOT carry over or refund upon cancellation
• Offline AI Pack add-on - separate cancellation: The add-on is cancelled separately via Google Play (Play Store → Subscriptions → Offline AI Pack → Cancel). Cancelling your main plan does NOT cancel the add-on, and cancelling the add-on does NOT cancel your main plan.
• Offline AI Pack add-on - access after cancellation: After cancellation, on-device AI access continues until the end of the current paid period and briefly thereafter while your device re-verifies, then stops. The same refund policy (48-hour window per Google Play) applies to the add-on.
• Grace Period: If payment fails, you have 3 days to update payment before access is suspended

3.4 Price Changes & Grandfathering

• We reserve the right to change subscription prices
• Existing subscribers: Price changes apply ONLY at renewal, with 30 days advance notice via email and in-app notification
• You will be notified before your next billing cycle if price increases
• You may cancel before renewal if you don't accept new pricing
• Promotional pricing may be offered temporarily - reverts to standard pricing after promo period
• These price-change and grandfathering terms also apply to the Offline AI Pack add-on price (₹100/month)

4. Account Registration & Security

4.1 Account Creation

• You must provide accurate, complete information
• One account per person/email address
• You must register via Google Sign-In (email/password registration is disabled for security)
• You are responsible for maintaining account confidentiality

4.2 Account Security

• Keep your Google account secure and confidential
• Notify us immediately of unauthorized access
• You are liable for all activities under your account
• Do not share your account with others

4.3 Account Termination

We may suspend or terminate your account if:

• You violate these Terms
• You engage in fraudulent or illegal activity
• You abuse the Service or harm other users
• Required by law or legal process

5. Acceptable Use Policy

5.1 Permitted Use

You may use Browsist AI for lawful purposes including:

• Personal productivity and learning
• Creative content generation (writing, art, ideas)
• Research and information gathering
• Professional work assistance (coding, emails, analysis)
• Educational purposes
• Business use (within subscription limits)

5.2 Prohibited Activities

You agree NOT to use Browsist AI for:

• Illegal Activities: Generating illegal content, planning crimes, terrorism, violence
• Harmful Content: Child abuse material, extreme violence, self-harm instructions
• Harassment: Bullying, threats, hate speech, doxxing
• Fraud: Phishing, scams, impersonation, fake information
• Copyright Violation: Generating copies of copyrighted works, piracy
• Spam: Mass messaging, unsolicited commercial content
• Account Abuse: Sharing accounts, creating multiple accounts for quota abuse, selling access
• Technical Abuse: Reverse engineering, hacking, DDoS attacks, bypassing rate limits
• AI Provider Violations: Content violating OpenAI or Google's usage policies
• Malicious Code: Uploading viruses, malware, or harmful scripts
• Automated Scraping: Bots, scrapers, or mass automated requests
• Sexual Content: Sexually explicit material, adult content (per AI provider policies)
• Political Manipulation: Election interference, misinformation campaigns

Violations may result in: Warning, account suspension, permanent ban, legal action.

6. Content & Intellectual Property

6.1 Your Content

• You retain ownership of content you input (prompts, uploads)
• You grant us license to process your content to provide Services
• You are responsible for your content and must have rights to use it

6.2 AI-Generated Content

• AI responses are generated by third-party models (OpenAI, Google)
• We do not claim ownership of AI-generated content
• You may use AI-generated content subject to AI provider terms
• AI outputs may not be unique or exclusive to you
• You are responsible for verifying accuracy and legality

6.3 Our Intellectual Property

• Browsist AI name, logo, app design, and code are our property
• You receive a limited, non-exclusive license to use the App
• You may not copy, modify, or distribute our intellectual property

7. Disclaimers & Limitations

7.1 Service "As-Is"

7.2 AI Limitations

• AI models may produce incorrect, biased, or misleading information
• Do not rely solely on AI for medical, legal, or financial advice
• AI responses reflect training data and may be outdated
• Always verify important information from authoritative sources

7.3 Third-Party Services

• We integrate OpenAI, Google Gemini, and other third-party services
• We are not responsible for third-party service availability or content
• Third-party terms apply to their respective services

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• We are not liable for indirect, incidental, or consequential damages
• Our total liability is limited to the amount you paid in the last 12 months (max ₹4,999)
• We are not liable for data loss, business interruption, or lost profits
• These limitations apply even if we were advised of potential damages

9. Indemnification

You agree to indemnify and hold us harmless from claims arising from:

• Your violation of these Terms
• Your content or use of the Service
• Your violation of third-party rights
• Your negligence or misconduct

10. Data & Privacy

• Your use of Browsist AI is governed by our Privacy Policy
• We collect and process data as described in the Privacy Policy
• You consent to data collection and processing by using the Service
• You may delete your account and data at any time

10.1 Account Deletion and Data Retention

IMPORTANT: When you delete your account, we retain limited information for fraud prevention and security purposes as described in our Privacy Policy.

• What is retained: Email address, Google account ID, account identifier, deletion timestamp, usage statistics at deletion, and subscription information at deletion
• Purpose: Prevent abuse of free tier service, fraud prevention, security, and compliance
• Re-registration policy: By default, deleted accounts cannot re-register with the same email or Google account to prevent quota abuse
• Your rights: You may request complete removal of all data, including deletion records, by contacting support@browsistai.com with the subject "Complete Data Removal Request"
• Processing time: Complete data removal requests are reviewed case-by-case and processed within 30 days

For complete details on data retention after account deletion, please refer to Section 7.2 of our Privacy Policy.

11. Changes to Terms

• We may update these Terms from time to time
• Material changes will be notified via email or in-app notification
• Continued use after changes constitutes acceptance
• "Last Updated" date will reflect the latest revision

12. Termination

12.1 By You

• Cancel subscription via Google Play Store
• Delete account in app Settings
• Contact support to request account deletion

12.2 By Us

• We may terminate accounts for Terms violations
• We may discontinue the Service with 30 days notice
• No refunds for partial periods upon termination

13. Dispute Resolution & Governing Law

13.1 Governing Law

• These Terms are governed by the laws of India
• Exclusive jurisdiction: Courts of Krishnagiri, Tamil Nadu, India
• For international users: You agree to Indian jurisdiction and laws

13.2 Dispute Resolution Process

1. Informal Resolution (Required First Step): Contact us at support@browsistai.com with detailed complaint. We'll respond within 7 days and attempt resolution within 30 days.
2. Mediation: If informal resolution fails, both parties agree to good-faith mediation before litigation.
3. Arbitration: Disputes not resolved by mediation shall be settled by binding arbitration under Indian Arbitration and Conciliation Act, 1996:
   • Arbitration conducted in English
   • Location: Krishnagiri, Tamil Nadu, India
   • Single arbitrator mutually appointed
   • Arbitrator's decision is final and binding
4. Class Action Waiver: You waive the right to participate in class action lawsuits. Disputes must be brought individually.

13.3 Exceptions to Arbitration

Either party may seek injunctive relief in court for:

• Intellectual property disputes
• Urgent security matters
• Small claims court matters (under applicable threshold)

14. Miscellaneous

• Severability: If any provision is invalid, the rest remains in effect
• No Waiver: Failure to enforce any right does not waive it
• Assignment: You may not transfer your rights; we may assign ours
• Entire Agreement: These Terms and Privacy Policy constitute the full agreement
